Class Action Update
Employers in the United States have the largest number of ‘out of state’ employees in 2025 than any prior year. Partially a result of the migration out of urban areas we saw during COVID, and also due to more flexible remote working arrangements offered by employers, this is not a trend that is likely to change anytime soon. The downside of this development is the resulting patchwork of state paid family leave laws employers find themselves contending with.
Following a multi-year effort, the House has proposed two bills to help this issue, H.R 3089 and H.R. 3090.
H.R. 3089- ‘More Paid Leave for More Americans Act’ would offer grants to states that implement paid family leave programs, with six or more weeks of paid leave, and cover absences related to child birth and adoption.
H.R. 3090- ‘Interstate Paid Family Leave Action Network Act’ will create a program for states to join, where they can share definitions, eligibility and other elements of paid family leave in an effort to coordinate leave policy across state lines.
Both bills aim to offer solutions for employers that wish to streamline their leave administration, and do not create affirmative legal obligations as currently drafted. These bills have bipartisan support, but have a ways to go before hitting the President's desk.
